Regulations of Beijing Municipal Commission of Housing and Urban-Rural Development on Handling Construction Permits Directly for Construction Projects not Subject to Tenders
To commissions of housing and urban-rural development of all districts concerned, commissions of housing and urban-rural development of Dongcheng District and Xicheng District, Beijing Economic-Technological Development Area C&D Bureau and all units concerned,
In order to further implement the arrangements and requirements of the municipal Party committee and the municipal government on “optimization of business environment”, effectively safeguard the rights of employers to select engineering contractors and supervisors at their discretion and quicken the handling of examination and approval procedures of construction permits, relevant matters are hereby notified as follows:
I. In accordance with relevant provisions of the Provisions on Construction Projects Subject to Mandatory Tenders (Decree No.16) promulgated by the National Development and Reform Commission on March 27, construction projects other than those subject to tenders may refer to construction projects by social investment and employers can decide the mode of contract awarding at discretion as tendering and bidding are no longer mandatory.
II. Any employer that decides the mode of contract awarding at its discretion for a construction project not subject to tender does not need to submit construction and supervision contracts for filing anymore and can handle construction permit directly after it determines the contractor and the supervisor for the construction project.
III. No filing and registration fee will be collected for the construction contract and supervision contract of a construction project not subject to tenders if no bidding is invited for this project on the Construction Project Sub-platform of Beijing Public Resources Trading Service Platform.
IV. As for the selection of contractors and supervisors, employers should select the enterprises and practitioners with corresponding qualifications matched with the scale of construction projects in order to effectively perform their main responsibilities of management on such contractors and supervisors according to relevant laws and regulations.
This Notice shall come into force as of June 1.
