Notice on Online Verification of Legal Documents and Lawyer Identity for Online Query of Real Estate Registration Information
To all branches:
To earnestly implement the business environment innovation pilot work, deeply advance the reform of “Internet + real estate registration”, and further optimize Beijing’s business environment development, Beijing Municipal Commission of Planning and Natural Resources will provide lawyers with online query services for real estate registration information authorized by Beijing Municipal Higher People’s Court and Beijing Municipal Bureau of Justice based on the online verification of legal documents. We hereby give the notice on related matters as follows:
I. Scope of Application
Since May 27, 2022, all investigation orders (scanned file in the format of PDF or JPG) issued by the local people’s courts at all levels shall be sent to the government mailbox of the real estate registration center where the immovable property is located in an intensive manner. After Beijing Municipal Higher People’s Court completes the research and development of relevant system functions, these orders shall be sent via the system for interactive sharing. The practice certificate information of lawyers registered in Beijing shall be shared with the real estate registration center through the data interface by Beijing Municipal Bureau of Justice. When a lawyer holding an investigation order applies for real estate query services online or offline, the legal documents and lawyer’s practice certificate that have been verified as genuine need not to be submitted repeatedly.
Ⅱ. Handling procedures
(1) Handling process
1. Online application. The lawyer logs in to “Beijing Municipal Online Service Platform for Real Estate Registration”, enters the module of “Information Query” - “Registration Information Query” - “Lawyer Query”. After the real-name authentication via “Beijing Tong” APP, the lawyer fills in the information such as application information, investigation order number and lawyer practice certificate number.
2. Uploading materials. The lawyer submits and uploads the following application materials:
(1) Application form for Query of Real Estate Registration Information;
(2) A letter of introduction from the employer.
Application materials shall be uploaded in the format of PDF or JPG with complete contents, neat pages and clear images. Paper materials with red heads or seals shall be scanned or photographed in color mode.
3. Online verification When examining the application materials, the real estate registration center shall verify the court’s investigation order online through the government mailbox, and check the lawyer’s practice certificate online through the “Lawyer Identity Verification Module” of the real estate registration information system.
4. Result issuance If the application materials are complete and eligible for query, the real estate registration center shall issue the query result. If the application materials are not complete or do not meet relevant requirements, please inform the lawyer of the reason online. The query result can be obtained online through “Beijing Municipal Online Service Platform for Real Estate Registration”.
The query result obtained online and offline has the same legal effect.
(2) Time limit
It shall be handled on the same day. For applications submitted after 16:00 on working days, the time limit for handling will be extended to the next working day. In principle, the delay of reply under special circumstances shall not exceed 3 working days.
(3) Other modes
If the lawyer apply for the real estate registration information query at the window of the real easter registration center with the court’s investigation order, it shall be handled in the original way.
Ⅲ. Work requirements
(1) Strengthening inter-departmental cooperation
Beijing Municipal Higher People’s Court and Beijing Municipal Bureau of Justice shall strengthen guidance and supervision over the people’s courts and judicial administrative departments at all levels, ensure timely and accurate information sharing with the real estate registration center, regularly update and maintain relevant data, and actively explore more intelligent, convenient and accurate information sharing and online verification services.
(2) Enhancing business training
All real estate registration centers shall strictly implement various reform measures to optimize the business environment and assign relevant personnel to conduct data docking. They shall strengthen the business training of the working staff to ensure timely and accurate feedback of query results.
(3) Improving publicity guidance
All relevant departments shall properly deal with publicity and public opinion guidance, encourage lawyers to apply for real estate registration information query online, and effectively prevent the risk of the COVID-19 pandemic. This notice shall take effect on May 27, 2022.
