Circular of Beijing Municipal Commission of Housing and Urban-Rural Development on Further Clarifying the Quality and Safety Supervision and Inspection During the Construction of Simple and Low-Risk Construction Projects

To relevant organizations,

　　To further optimize the doing business environment in Beijing, effectively promote the reform of delegating powers, improving regulation and optimizing services, and further clarify the requirements for quality and safety supervision and spot check during the construction of simple and low-risk construction projects, related matters are hereby notified as follows in accordance with the spirits of the SeveralProvisions on Optimizing the Examination and Approval Service for Simple and Low-risk New Construction Projects with Social Investment(Jing Zheng Ban Fa [2019] No. 10) and the Opinions on Improving the Examination and Approval Services for Simple and Low-risk Construction Projects (Jing Gui Hua Guo Tu Fa [2019] No. 439) (hereinafter referred to as the “Document No. 439”).

　　I. As mentioned in this Circular, “simple and low-risk construction projects” refers to the new construction, reconstruction & expansion and internal decoration projects with social investment that meet the low risk level of quality and safety, have an above-ground construction area of no more than 10,000m²and a building in height of no more than 24m with single function and simple technical requirements (except for underground space development projects and special construction projects. See the “Document No. 439” for details).

　　II. Housing construction projects with an investment of less than 1 million RMB, or a construction area of less than 300m²(including 300m²) shall not be included in quality and safety supervision, and shall not be supervised and inspected.

　　III. The quality and safety supervision of Beijing’s simple and low-risk construction projects shall follow the principle of territorial supervision, and the district-level competent authority of housing and urban-rural development shall be accountable for the quality and safety supervision of simple and low-risk construction projects within its administrative area.

　　The supervision organization of project quality and safety established by the district-level competent authority of housing and urban-rural development shall be specifically responsible for implementing the quality and safety supervision and inspection during the construction. In case that the supervision organizations of project quality and safety are separately established, the quality supervision organization shall take the lead to carry out the quality and safety inspection with the cooperation of the safety supervision organization.

　　IV. After the owner obtains the construction permit, the district-level competent authority of housing and urban-rural development or its supervision organization of project quality and safety shall, in a timely manner, obtain the verification data through the One-stop Service System for Simple and Low-risk Projects with Social Investment (hereinafter referred to as the “One-stop System”) and other relevant information systems. The simple and low-risk construction projects shall be included in the scope of construction quality and safety supervision, and a supervision plan shall be prepared in time.

　　V. The supervision organization of project quality and safety shall, in accordance with the “Document No. 439”, work out a supervision plan and implement differentiated supervision according to the scale, nature, use, geographical location sensitivity, risk of comprehensive management capacity and other factors of the project. The supervision plan shall specify supervision basis, specialty settings, main contents and one spot check during the construction etc.

VI. For simple and low-risk construction projects, the supervision organization of project quality and safety shall cancel the first briefing of quality and safety, and only carry out supervision and inspection once during the construction, with the longest time not exceeding one day.

It is advisable to carry out supervision and inspection in the construction stage of engineering structure for new construction, renovation and expansion projects, and for interior decoration projects, supervision and inspection should be carried out according to the construction progress and technical characteristics of the projects.

　　VII. The supervision organization of project quality and safety shall comply with the Provisions on the Supervision and Administration of the Quality of Housing Construction Projects and Municipal Infrastructure Projectsand the Provisions on the Supervision of Construction Safety of Housing Construction Projects and Municipal Infrastructure Projectsof the Ministry of Housing and Urban-Rural Development, as well as other relevant rules in Beijing, and shall carry out the supervision and inspection once during the construction of simple and low-risk construction projects by spot check and spot testing as the main means. Spot check shall focus on the followings:

　　1. Implementation of related laws, regulations and compulsory standards on engineering construction by related construction units;

　　2. Spot check and spot testing of the quality of engineering entities involved in the safety of the engineering structure and the major functions;

　　3. Spot check and spot testing of the quality of major building materials, building components and fittings, and equipment;

　　4. Spot check on the performance of work safety responsibilities by the entities responsible for the project and the implementation of work safety standardization in construction.

　　VIII. The supervision organization of project quality and safety shall appoint two or more supervisors to supervise and inspect the construction sites of simple and low-risk construction projects according to the supervision plan and actual needs, and prepare theSupervision and Inspection Report on the Quality and Safety of Construction Projects in Beijing(as attached hereto) and upload it to the “One-stop System”.

IX. Where the supervision organization of project quality and safety finds that the entity responsible for project quality and safety violates laws and regulations and compulsory standards for engineering construction, or fails to perform statutory quality responsibilities and obligations, the organization shall order the entity to make corrections. In case of any illegal acts or clues found, administrative penalty shall be imposed according to the law or such illegal acts or clues shall be transferred to the relevant responsible authority for investigation and handling. The relevant information of the penalty shall be published on the official website of the competent authority of housing and urban-rural development.
