Regulation on Strengthening Survey and Design Quality Supervision and Management and Optimizing and Perfecting the Management Mode of Construction Drawing Review
To relevant units,
To implement the relevant requirements of the Regulation of the General Office of the State Council on Launching the Pilot Program of the Reform of the Approval System for Construction Projects (Guo Ban Fa [2018] No. 33), further stimulate construction market vitality, and strengthen the main responsibilities on quality and safety of survey and design, it is decided, on the basis of research, to further optimize and perfect the management mode of construction drawing review. Related matters are notified as follows:
I. Adjustment of the management mode of construction drawing review for part of projects
(1) Cancel the prior review for construction drawing of internal renovation projects. For internal renovation projects of 300 m2 - 2,000 m2 (excluding projects involved in civil air defence), design project manager should be a registered architect. The person, who is responsible for change to main structure of building, should be a registered structural engineer. The design quality and safety responsibilities should be assigned by the signatures and seals of registered engineers. Regulatory authorities will conduct inspection at a certain percentage. Except the crowded places and the special construction projects covered in Article 13 and Article 14 of Regulation on the Supervision and Administration of Fire Protection of Construction Projects (Order No. 119 of Ministry of Public Security).
(2) Cancel the prior review for construction drawing of small size new and expansion projects; and establish post design quality inspection therefor. The construction drawings of the new and expanded buildings with the above ground building area of a single building smaller than 5,000 m2 and the underground building area smaller than 2,000 m2 need not to be reviewed before commencement. However, the post design quality inspection is required. Except the crowded places and the special construction projects covered in Article 13 and Article 14 of Regulation on the Supervision and Administration of Fire Protection of Construction Projects (Order No. 119 of Ministry of Public Security).
(3) Optimize the review procedures and review scope for projects of medium and large. Further optimize and improve the review efficiency for projects of medium and large size. For new and expansion projects with the above ground building area of a single building smaller than 5,000 m2 or the underground building area smaller than 2,000 m2, and all the municipal infrastructure engineering projects, without security issues seriously affecting the foundation, main structure and fire protection of the building as well as the related civil defense standards, the review agency should issue a Notice of Comprehensive Review within 15 working days. The survey and design company needs to modify and improve the construction designs based on the review comments, and the review agency shall not conduct a second review. For projects with above issues, the review agency should provide the Opinions of Modification on Comprehensive Review within 15 working days. The survey and design company needs to make corrections in a timely manner, and the review agency would conduct a second review on the modified results. After the second review, a Notice of Comprehensive Review will be issued.
II. Enhance the concurrent and post supervision and the closed -loop management
For the above-mentioned projects with classified management, construction company and design company shall promise to upload the digital files of the construction drawings to the digital graphic review system of Beijing at the moment of commencement. Beijing Municipal Commission of Planning and Natural Resources will send the construction design drawings and files and the Notice of Comprehensive Review to the relevant construction project regulatory authorities, thus strengthening the joint supervision of the construction process and the completion acceptance.
III. Further reinforce the quality safety responsibility
(1) Further strengthen the industry supervision. For the new and expansion projects with the above ground building area of a single building smaller than 5,000 m2 or the underground building area smaller than 2,000 m2, and the internal renovation projects covering an area larger than 2,000 m2, the authorities undertaking the comprehensive review and supervision responsibilities of the construction drawing should jointly entrust the review agency of construction drawings to inspect the design quality of the design company.
(2) Construction company should be responsible for the quality of construction project according to laws and regulations, not delay to pay for survey and design fees, not randomly shorten the reasonable construction period, and submit authentic, accurate and complete original materials related to the construction project to the survey and design company. At the same time, it is necessary to strengthen the control and management of project quality and safety. It is not allowed to ask the survey and design company to violate the mandatory standards for project construction in any way and lower the quality of the project.
(3) The survey and design company shall be respectively responsible for the quality of survey and design of construction projects and carry out survey and design in accordance with laws and regulations as well as mandatory standards for construction of projects. The survey and design company shall strengthen the quality and safety guarantee system, improve the internal quality control system, strictly carry out the tasks of checking, auditing and review, and ensure that the construction drawings and documents meet the requirements of public interest, public safety, project construction standards, and relevant regulations on design depth. Designer should meet the corresponding requirements for registration and license qualifications, have corresponding professional and technical capabilities, and must not allow others to undertake project designs in his/her name.
(4) The review agency of construction drawings should strictly review the construction drawings and inspect the quality thereof in accordance with laws, regulations and mandatory standards of project construction. Improve the internal management procedures, arrange the review period in a reasonable manner, guarantee the review quality and report review results faithfully.
IV. Intensify credit management of the survey and design company
Based on the review results generated by review agency of construction drawings, relevant authorities will establish a joint punishment mechanism, intensify credit management of the survey and design company, and take actions based on classification of the review and inspection results:
(1) For the problems that seriously affect the foundation and main structure, fire safety and safety standards of civil air defense engineering protection, the various supervisory authorities will supervise the survey and design company in time to rectify according to their duties, punish the survey and design company in accordance with the law for the violation of the mandatory standards for project construction.
(2) In case of violation of general project construction standards and rules, the design company should commit self-correction, and the review results will be on record and file. Beijing Municipal Commission of Planning and Natural Resources will circulate a notice of criticism on the design company and project manager based on the review results regularly.
(3) Praise the survey and design company with excellent design quality or the person responsible for the projects with outstanding quality yearly, and reduce the inspection frequency or exempt the inspection.
(4) Classify the survey and design company that fail to upload the survey reports or the construction design drawings and files in time as dishonest enterprises based on the whole process supervision results, and report publicly.
V. Policy coordination
In case that technical consultations on construction drawings are conducted for “One Meeting and Three Documents” and green channel before the commencement of construction, reviews of construction drawings are not required, and the Technical Consultation Report on Construction Drawings issued by review agency should be considered as the basis for procedures in the later stage.
This Regulation shall be effective since the date of promulgation.
