Supplementary Circular on Improving the Whole-process Service Supervision Work for Simple and Low-risk Construction Projects


To relevant organizations,

To implement the Opinions on Improving the Examination and Approval Services for Simple and Low-risk Construction Projects (hereinafter referred to as the “Opinions”), the Supplementary Circular on Improving the Whole-process Service Supervision Work for Simple and Low-risk Construction Projects is hereby issued according to the requirements of the Regulations on Implementing the Whole-process Service Supervision Work for Construction Projects of Simple and Low-risk New Construction Projects with Social Investment(Jing Gui Zi Fa [2019] No. 170) :

I. Within the application scope of the Opinions, the simple and low-risk construction projects with construction project planning permits should be incorporated into the scope of whole-process service supervision.

II. On the basis of keeping the original content, mode, process and system of whole-process service supervision unchanged, the planning and natural resources verification department should follow up the service supervision of simple and low-risk projects in a timely manner, provide high-quality policy consultation and coordination services, and focus on verifying whether the construction of key projects conforms to the planning.

III. After the construction of the project is completed in accordance with relevant laws and regulations, the planning and natural resources verification department shall take the initiative to issue planning and verification opinions according to the Verification Report, Research Report, on-site photos and other information provided by the third-party service agency. The science and information department of our commission is responsible for sharing the planning verification opinions to the “One-stop Express” system, and sending them to the housing and urban-rural development department, the public security department and the real estate registration department.

IV. The planning and natural resources verification department shall carry out on-site survey without any interruption, and shall not interfere with the owner unless with special reasons. If it’s really necessary to contact the owner for on-site survey, it shall fill in the “Record Form of Onsite Survey Verification of Construction Project Planning”, explain the reasons in writing and obtain the approval of leaders. The planning and natural resources verification department can grasp the situation of the project site and its surroundings by means of aerial photos, satellite images, street views and other technologies.

V. After the construction of the project is completed in accordance with relevant laws and regulations, the planning and natural resources verification department shall take the initiative to issue the planning verification opinions. The owner doesn’t need to provide the approval documents, surveying and mapping results, completion drawings or other documents. The approval documents issued by the government departments that need to be examined for the planning verification shall be obtained through data sharing among government departments; the compliance condition of the construction project with the planning and construction shall be provided by a third party service agency hired by the government; the completion drawings of the project shall be collected for filing by the urban construction archives department when the owner applies for joint acceptance; for projects not subject to joint acceptance with an engineering investment amount below RMB 1million or a floor area of less than 300 m2 (inclusive), the urban construction archives department will not collect the completion drawings for filing, but make reference to the planning approval files.

VI. Implement the commitment system of the owner and credit management. During the whole-process service supervision, the planning and natural resources verification department should take the initiative to strengthen relations with the owner, publicize the relevant policies, clarify responsibilities and obligations, and inform relevant provisions on the expropriation of urban public land such as vacation, return, and transfer, as well as the requirements on construction, acceptance and transfer of public service facilities. The owner should carry out project construction in accordance with laws, regulations and drawings, actively satisfy the relevant requirements and give feedbacks on project progress. For those who fail to implement the commitment system, deliberately give false information or fail to fulfill their obligations or responsibilities, joint disciplinary actions shall be taken in accordance with theMeasures on the Administration of Disciplinary Actions Taken against Dishonesty in the Approval Commitment System in the Construction Field of Beijing (Trial) (Shi Gui Hua Guo Tu Fa [2018]No. 350).

VII. If the planning and natural resources verification department finds any illegal construction during the whole-process supervision, it shall report the relevant clues to the law enforcement department for investigation, and continue to carry out the whole-process service supervision after handling in accordance with the law.
