Circular of Beijing Municipal Bureau of Land and Resources and Beijing Municipal Commission of Housing and Urban-Rural Development on Matters regarding the Implementation of a Uniform System of Real E

It is hereby notified that:

Beijing has completed the consolidation of real estate registration functional authorities, and has decided to implement a uniform system for real estate registration beginning on November 9, 2015 and enable the use of Real Estate Register. The details are hereby notified as follows:

I. Real estate registration authorities

According to the Notice on Consolidating Municipal Functions for Real Estate Registration issued by the Office of Organizational Structure Committee of Beijing Municipality, Beijing Municipal Bureau of Land and Resources shall be the real estate registration authority of Beijing Municipality, including registration responsibilities with regard to real properties including land, housing and forest previously undertaken by competent municipal, district, and county authorities. The administration responsibilities of real estate still rest with the existing competent authorities. The inclusion of rural land contracted management rights in uniform real estate registration of the city is granted a five-year transitional period. Upon expiry of the transitional period, Beijing Municipal Bureau of Land and Resources will take over the registration of rural land contracted management rights.

Beijing Municipal Real Estate Registration Center undertakes routine real estate registration for entities directly under the Central Government in Beijing, armed forces stationed in Beijing and secret units; while real estate registration centers at district and county levels undertake routine registration of real properties (excluding military, central and secret real properties) within their respective administrative regions. See the Attachment for office addresses and hotlines of municipal, district and country real estate registration centers.

To facilitate the general public in handling housing transactions and applying for real estate registration and reduce transaction and handling costs, Municipal Commission of Housing and Urban-Rural Development housing transactions counters will be, in principle, retained at district and country real estate registration centers to enable “one-stop” formalities handling as possible.

II. Effective date of the Real Estate Register and the efficacy of the existing certificates

Beijing will officially switch to the Real Estate Register beginning on November 9, 2015. Real estate registration applications accepted on and following this date will be handled as per the uniform procedures for real estate registration and issued a real property ownership certificate; while various applications for housing registration and land registration accepted prior to this date will be issued property and land ownership certificates as per the existing working procedures.

After the adoption of the Real Estate Register, the ownership certificates of property and land issued and registers produced by the original registration authority in accordance with law will remain effective without any change of rights and replacement of registers on a “no change and no replacement” basis.
