Notice of Beijing Municipal Bureau of Land and Resources on Further Regulating the Assessment and Management of Mining Right Cost

Relevant branches of Beijing Municipal  Bureau of Land and Resources and mining right related assessment agencies:

In the light of the Notice on Well Implementing the First Batch of 62 Items subject to Administrative Review and Approval by Local Government Cancelled by the State Council (Jing Shen Gai Ban Han [2015] No. 74), we decided to cancel the Assessment and Confirmation of Mining Right Cost of solid and mineral water. In order to carry out the follow-up work, and further regulate the assessment and management of mining right cost of solid and mineral water, related requests are hereby notified:

First, regulate the procedures for the assessment and management of mining right cost

 (1) Establish agency database for the transfer price assessment of mining right

We have established agency database for the transfer price assessment of mining right through open tendering. After application for the assessment of mining right cost to our bureau by the legal person of mining right, we will, according to the rule of open, equity and justice, randomly select a qualified assessment agency to assume the assessment from the database by lottery. Correlative charges shall be assumed by our bureau.

 (2) Implement contract management

In the light of the Notice on Matters Related with Mining Right Transfer Assessment Commission by the Ministry of Land and Resources (Guo Tu Zi Fa [2008] No. 181), we will sign a contract with the selected assessment agency. The above-mentioned assessment shall accomplish the relevant work within the period as specified in the contract and submit materials like the assessment report, main parameter list of assessment report, and letter of commitment. Our bureau shall afterwards inspect if the materials are all ready, complete and canonical.

 (3) Implement informative publicity

Qualified assessment report, main parameter list of assessment report and the letter of commitment shall be publicized on our bureau's web portal for 10 working days. In the case of no objection upon expiration of the term for publicity, cost payment notification shall be issued in accordance with the result of publicity; if there are any objections during the term of publicity, the assessment agency shall be responsible for researching and explaining the corresponding comments one by one. Related case and modified materials shall be publicized again. The cost payment notification shall be issued in accordance with the result of publicity only when there is no objection during the term of publicity.

Second, strengthen the during and after event supervision

 (1) Strengthen the credit constrains of assessment agencies

Assessment service agencies that included in our database shall strictly obey the relevant laws and regulations, observe professional ethics, and act in accordance with the assessment procedures, so as to ensure the objectivity and fairness of the assessment result; they shall strengthen self-discipline and establish a commitment system for lawful practice. The assessment agencies and appraisers shall stamp and sign on the letter of commitment to bear legal liability for the independence, objectiveness, fairness and authenticity of the assessment report; management of hired appraisers shall be enhanced. If there is any quality problem in the assessment report, the assessment agencies and appraisers shall bear the corresponding legal liability independently.

 (B) Timely dynamic maintenance of the agencies database

Our bureau shall, in the light of the Interim Methods of Beijing Municipal  Bureau of Land and Resources for the Management of Service Agencies Database, assess the service quality of the members in the database, and provide dynamic maintenance in accordance with the result of assessment. In the case of practice fraud and violation of laws and rules among the assessment agencies and appraisers, they shall be removed from the database and assume relevant liability according to laws and rules once verified.

 (3) Stress on assessment discipline

Any entity or individual shall not intervene or inspire the assessment result or conclusion, and shall not make any requests beyond the commission contract; otherwise relevant liability shall be investigated and affixed in accordance to laws and rules.
