Notice on Further Enhancing Administration of Industrial Projects

People's governments of all districts and all relevant units:
As approved by Beijing Municipal Government, in order to guarantee continuous and healthy development of various industries in the city, on the basis of further strict execution of the Notice on Issues about Enhancing R&D and Industrial Project Supervision (JGTY〔2010〕No.480) and the Notice on Issues about Enhancing Administration of Sales of Hotel-related Project (JJF〔2010〕No.265), all industrial projects with the planned purposes of scientific research, industry, hotel, tourism, culture and entertainment (hereinafter referred to as industrial projects) shall execute the following provisions concurrently from the date of issue of this Notice on:
1. Industrial projects should be designed, developed, constructed and used strictly in line with the planned purpose and must not be transferred and sold severally without approval. Unauthorized change of the project’s planned purpose to residential use is strictly prohibited.
2. Firmly fighting against speculation in land and housing under the disguise of industrial project land. Efforts should be made to examine uses of the projects completed and in progress according to relevant land transfer contract and land allocation and approval documents. Meeting any industrial project having been changed to residential use, relevant departments of planning, land and resources and housing and urban-rural development will impose stricter punishment on the project owner according to laws, even cancel relevant land transfer contract, withdraw the allocation approval document, take back the plot, abolish the owner’s qualification for acquiring land in Beijing and arrange for taxation and other departments concerned to carry out audit and check.
3. The buyers of industrial projects (including those resoled after sales) should be enterprises, institutions, social organizations or individuals in line with corresponding requirements. The administrative department or park management department responsible for the industrial projects should follow requirements of their regional industrial policy to verify the buyers’ qualification for the purchase, issue written opinions and properly carry out following supervision.
4. Controlling supply of industrial land strictly. The industrial projects should conform to the functional positioning of the capital city and to the Directory of Beijing for Banned and Limited Projects of Newly Increased Industries. Meanwhile, governments of the districts with jurisdiction over the projects should follow regional planning concerned to keep service-residence balance. In the six districts of the main urban area, measures should be taken to strictly prohibit development of high-end manufacturing-related production and processing links, construction and expansion of new or existing wholesales marketplaces and of new or existing regional logistics centers, etc.
Industrial projects with the land supplied in manner of agreement-based transfer shall be managed and controlled in manner of level by level in the urban area and of limiting qualifications of the assignees. All district governments, park management departments and competent departments of all industries should examine and determine project owners and executors concerned from aspects of industrial policy, industrial scale, industrial scheme, industry requirements, population regulation and positioning of regional functions, etc.
For industrial projects with the land acquired in manner of bidding, auction and listing for sales, relevant planning and land and resources departments should specify building use function, land transfer conditions, proportion of the building area for project owners’ use and occupation and project land withdrawal conditions in the land transfer contracts, and strictly carry out final-period supervision.
5. Relevant district governments and park management departments should organize comprehensive regular assessment of industrial projects from aspects of industrial contents, output value, tax, employment and ecological and environmental protection, etc., and execute industrial project withdrawal mechanism for those not conforming to requirements of Beijing.
Relevant planning and land and resources departments should regularly examine building use function, correct and punish those having changed the contracted use to residential use against relevant provisions in time, even cancel their land transfer contract, cancel the allocation approval document and take back the land.
6. Project owners, if violating relevant provisions, will be punished by competent administrative department and relevant information will be recorded in the municipal enterprise credit information system.
Any intermediary organization, if acting as agent or taking any other means to giving publicity to houses of industrial projects as residential use, will have the filing canceled even the business license revoked by competent administrative departments.
