Recently, Beijing Municipal Bureau of Land and Resources has discovered three typical cases on illegal land occupancy through media and other channels.
To firmly curb the rise of land-related illegal acts and increase further efforts to investigate into and deal with illegal occupancy of rural collective land for non-agricultural construction, with respect to these three cases, it is decided to supervise and handle two cases and publicly communicate one case as follows:
I. Particulars of Two Cases Subject to Supervision and Handling
1. A Case on Illegal Possession by Beijing Yushan Investment Co., Ltd. of the Collective Land situated in Xifengshan Village, Liucun Town, Changping District
2. A Case on Illegal Possession by Beijing Xisanqi Xinlong Commerce & Trade Group of the Collective Land situated in Sanhezhuang Village, Huilongguan Town, Changping District
Beijing Municipal Bureau of Land and Resources is seriously investigating into, or is urging local government to organize relevant departments to investigate into the above cases, and relevant investigation results will be released in due course.
II. Particulars of One Case Subject to Public Communication (Case on Illegal Possession by Zhang Xuege of the Collective Land situated in Qianquhe Village, Gaoliying Town, Shunyi District)
Upon investigation, it is determined that Zhang Xuege illegally constructed a property on the land parcel situated in Qianquhe Village, Gaoliying Town, Shunyi District with an area of approx. 13 mu. Currently, the land is used as a cultivated land and the land is planned in general to be used as a basic farmland preservation area.
In May 2012, Zhang Xuege and Qianqu Village Committee entered into a Land Lease Agreement with respect to the aforesaid land parcel for a lease term of 11 years.
In March 2014, Zhang Xuege constructed a 300 m2 brick-concrete house on the land parcel.
In September 2014, our Shunyi Office discovered such illegal act when investigating land change matters, upon which the Office promptly dismantled the house by law in conjunction with Gaoliying Town People's Court. At present, all the objects (including the housing property) have been dismantled and the land is reinstated to its original appearance.
