In order to implement the Xi Jinping Thought on the Rule of Law and Xi Jinping Thought on Ecological Civilization, promote the construction of ecological civilization and advance the rule of law of natural resources, and continuously strengthen coordination between administrative law enforcement and administrative procuratorate in the field of natural resources, on the afternoon of December 28, Han Chengjun, a Level-II senior prosecutor of the Seventh Procuratorial Office of the Supreme People’s Procuratorate, and Zhang Fuzhu, a Level-II inspector of the Law Enforcement Bureau of the Ministry of Natural Resources, visited the Beijing Mentougou District Procuratorate and held an investigatory symposium. Yan Junying, Director of the Seventh Procuratorial Department of the Municipal Procuratorate, Secretary of the Party Group and Procurator General of the Mentougou District, and Wang Guizhong, Second Inspector and Chief of the Law Enforcement Bureau of the Beijing Municipal Commission of Planning and Natural Resources, attended the symposium. Relevant comrades of the Seventh Procuratorate Department of the Municipal Procuratorate, some branches and heads of administrative procuratorial departments of district courts, and comrades in charge of the General Department of Law Enforcement of the Municipal Commission of Planning and Natural Resources attended the symposium.
At the symposium, the Municipal Procuratorate reported on the enforcement supervision of administrative non-litigation cases in the field of land disputes, law-enforcement problems encountered and follow-up work arrangements. The First Branch of the Municipal Procuratorate explained the overlapping of Article 64 of the Urban and Rural Planning Law and Article 77 of the Land Management Law; Officials in charge of the Haidian, Chaoyang, Changping and Mentougou divisions of the Municipal Planning and Natural Resources Commission reported on the coordination of administrative enforcement and administrative prosecution, the acceptance, transfer and disposal of confiscated buildings, the improvement of procedures for confiscated buildings in accordance with the law, and the overlapping of the laws applicable to Article 64 of the Urban and Rural Planning Law and Article 77 of the Land Management Law.
During the discussion, Zhang Fuzhu expressed his gratitude to the Seventh Procuratorial Office of the Supreme People’s Prosecutorate, Beijing procuratorial authorities and natural resources authorities for their strong support to the work of the Ministry’s Law Enforcement Bureau, which, according to him, will further guide and support the grassroots in engaging in more innovation and exploration. The natural resources authorities and the procuratorial organs have highly consistent goals and missions in protecting land resources, strictly adhering to the ecological red line, improving the standardization of law enforcement and effectively safeguarding the legitimate interests of the public. The Ministry’s Law Enforcement Bureau hopes to vigorously implement the joint law enforcement mechanism between the natural resources authorities and the procuratorial organs, adhere to the win-win concept to jointly solve urgent problems, to smooth out the “last mile” of land-related law enforcement and investigation, and to ensure that administrative penalties are put in place where necessary.
Han Chengjun acknowledged Beijing’s work on administrative law enforcement and administrative supervision in the field of natural resources, pointing out that Beijing, as a leading jurisdiction, is at the forefront of administrative law enforcement and supervision in the field of natural resources; and that Beijing has many good experiences and practices that can be scaled up nationwide. At the same time, three requirements were laid out: Firstly, attach great importance to the protection and use of land resources. Food security is an important cornerstone of national security, and the protection of land resources, especially arable land, is crucial to national security, social stability and people’s happiness. General Secretary Xi Jinping has repeatedly instructed on the protection of arable land, calling for hard measures to strictly guard the red line of 1.8 billion mu of arable land. The common mission of the procuratorial authorities and natural resources authorities is to resolutely implement the central government’s decisions and General Secretary Xi Jinping’s instructions. Secondly, practice the win-win concept and continue to strengthen the linkage and collaboration between the procuratorial organs and the competent departments of the Ministry of Natural Resources. The procuratorial authorities should strengthen their ties with the natural resources authorities, actively seek a broader consensus on law enforcement and justice, build innovative platforms, explore mechanisms for the interface between administrative law enforcement and administrative procurators in the field of natural resources that are suitable for Beijing, jointly contribute to the modernization of land law enforcement and justice, and enhance the authority and credibility of law enforcement and justice. Thirdly, focus on difficult issues and continue to deepen administrative non-litigation enforcement supervision in the field of land and natural resources. The procuratorial organs should promote the administrative and strict enforcement of the law through legal supervision, and resolve a number of influential cases with exemplary effect.
