Announcement of Beijing Municipal Bureau of Ecological Environmenton the Detailed Implementation Rules of Beijing Municipality for Classified Management Catalogue of Environmental Impact Assessment of Construction Projects (2019)
In accordance with the Environmental Impact Assessment Law of the People’s Republic of China, the Regulations on the Administration of Construction Project Environmental Protection, the Classified Management Catalogue of Environmental Impact Assessment of Construction Projects(No. 44 decree of Ministry of Environmental Protection, hereinafter, the “Classified Management Catalogue”), and the Decision on Amending Some Contents of Classified Management Catalogue of Environmental Impact Assessment of Construction Projects(No. 1 decree of Ministry of Ecological Environment, hereinafter, the “Amendment List”), and in light of the reality of the city, we revise the Detailed Implementation Rules of Beijing Municipality for Classified Management Catalogue of Environmental Impact Assessment of Construction Projects (2018)to formulate the 2019 version (hereinafter, the “Detailed Rules”, see Appendix 1), with a view to implementing the reform of “streamlining administrative procedures, delegating powers to lower levels, combining decentralization with control, and optimizing services”, further optimizing the business environment, and making it easier and faster for enterprises and the people to handling affairs. The announcement is as follows:
I. The owner shall strictly draft the environmental impact assessment documents for construction projects in accordance with the requirements of the Classified Management Catalogue, the Amendment List and the Detailed Rules, and shall not change the categories of environmental impact assessment without authorization.
II. The categories of items listed in the Detailed Rules shall be implemented in accordance with the relevant requirements of the Detailed Rules. Unless otherwise not listed in the Detailed Rules, it shall be subject to the Classified Management Catalogue and Amendment List.
III. According to the environmental impact of construction projects and the sensitivity of surrounding environment, the requirements for special assessment on engineering analysis, water, atmosphere, noise and environmental risk are put forward in the Detailed Rules as part of the project categories in the environment impact report form. If the district-level ecological environment agency considers it necessary to carry out a special assessment on the construction projects other than those specified in the Detailed Rules, the agency shall put forward suggestions and submit them to the Beijing Municipal Ecology and Environment Bureau for approval.
IV. Items not listed in the Classified Management Catalogue, Amendment List and Detailed Rules shall not be included into the environment impact assessment for construction projects in principle. However, the owner shall not be exempted from the responsibility of ecological and environmental protection. The owner shall comply with the national and municipal ecological environment laws, regulations, standards and relevant technical specifications, and take concrete and effective pollution control and ecological protection measures to ensure that pollutant discharge meets certain standards and mitigate the adverse impact of projects on the ecological environment during construction and operation. The owner shall also accept the supervision and management of ecological and environmental agencies at all levels.
V. For any construction project whose environmental impact assessment categories in the Detailed Rules are adjusted from the report form to the registration form, but cannot go through the registration formalities in the registration system of environmental impact registration form of construction projects, the owner shall fill in the paper version of the Registration Form for the Environmental Impact of Construction Project (Filed)and the Registration Form for the Environmental Impact of Construction Project (Return Receipt), and report to the district bureau of ecological environment for the record. See Appendix 2 for the specific operation process.
VI. If there are any amendments to the laws, regulations and relevant policies involved in the Detailed Rules, the amendments shall apply.
VII. The Beijing Municipal Ecology and Environment Bureau shall be responsible for the interpretation of the Detailed Rules, and shall revise them from time to time according to the actual conditions of the city.
VIII. The Detailed Rules shall come into effect on January 1, 2020. TheDetailed Implementation Rules of Beijing Municipality for Classified Management Catalogue of Environmental Impact Assessment of Construction Projects (2018)(Announcement of Beijing Municipal Bureau of Ecological Environment No. 3 of 2019) shall be abolished simultaneously.
The Regulation is hereby issued.

Simple and low-risk projects include: Public libraries and theaters (except for construction projects of underground space development by making use of green land, square land, urban road land, social parking land and other urban traffic land; gross construction area of no more than 2,500 m2; located in the planned urban and rural construction space; with sound municipal pipe networks, which require no self-built supporting sewage treatment facilities; not involving environmental sensitive areas; not located within the safety control scope of key organizations and subway).

Appendix 2
Paper Filing Operation Process for the Impact Registration Form for Construction Projects
For any construction project whose environmental impact assessment categories in the Detailed Implementation Rules of Beijing Municipality for Classified Management Catalogue of Environmental Impact Assessment of Construction Projects (2019)are adjusted from the report form to the registration form, but cannot go through the registration formalities in the registration system of environmental impact registration form of construction projects, the owner shall handling paper registration. The operation process is as follows:
I. Fill in the environmental impact registration form.The owner fills in the paper version of the Registration Form for the Environmental Impact of Construction Project (Filed)and the Registration Form for the Environmental Impact of Construction Project (Return Receipt).
II. Onsite declaration. The owner goes through the registration formalities at the relevant district-level government affairs service hall according to the construction location of the project.
III. Real-time handling. The district-level government affairs service hall accepts the application immediately, completes the registration formalities on the spot, and returns the Registration Form for the Environmental Impact of Construction Project (Return Receipt) with the record number to the owner.
IV. Information disclosure.The Registration Form for the Environmental Impact of Construction Project (Filed)is filed by the district-level ecological environment agency which will discloses the information on the registration form of environmental impact of the construction project to the public in a timely manner on its official website.
V. Supervision. The ecological environment agency will carry out supervision and inspection on the owner’s compliance with the Administrative Measures for Filing the Environmental Impact Registration Form for Construction Projects by means of spot checks and inspections on the basis of reports.
